A Somerset man convicted of serious sexual offences against a child under the age of 13 remains subject to lifetime sex offender management following his sentencing at Bristol Crown Court.

Barry Samways, formerly residing at Whiteway, Bath, appeared before the court on 26 February 2013 to be sentenced for sexual assault by penetration of a child under 13, alongside a series of related sexual offences.

The court imposed concurrent sentences totalling 13 years across the various charges on the indictment, resulting in an effective custodial term of six years’ imprisonment. Under statutory release frameworks in place at the time, offenders serving standard determinate sentences typically served half their term in custody before being released on licence under probation supervision.

In addition to the custodial disposal, the court ordered that Samways be made subject to indefinite notification requirements on the Sex Offenders Register. Under UK law, individuals placed on the register indefinitely retain the right to apply for a formal review of their notification requirements after a minimum period of 15 years has elapsed.

Following his release from prison, Samways was relocated under the statutory framework governing offender management. However, his allocation to accommodation located in the immediate vicinity of a school has prompted ongoing community scrutiny regarding the application of Multi-Agency Public Protection Arrangements (MAPPA) and the risk assessment processes utilised by local authorities and police forces.

Under the provisions of the Sexual Offences (Amendment) Act 1992, the child victim in this case is protected by mandatory, lifelong statutory anonymity. Any publication, broadcast, or public dissemination of information capable of leading to their identification is strictly prohibited under UK law.

Samways remains bound by the statutory notification requirements of the Sex Offenders Register and continued monitoring by public protection agencies.
