In 2022, the Offender Register reported that Dorniel Nica, then 28, who is already a registered Chester sex offender, was spotted using his phone camera to look under the next cubicle, with the girl believing he was performing a sex act on himself.
Nica was sentenced at Warrington Magistrates’ Court on Monday, November 21, after being convicted after trial following his not guilty pleas..
These charges related to the endeavour to observe a private act and voyeurism, and his conviction resulted in a violation of a suspended sentence order.
On October 2, Vincent Yip, the prosecutor, described how a teenage female had been in a cubicle of the public toilets at Golden Square Shopping Centre after experiencing nausea.
She observed a hand holding a black iPhone emerge from beneath the cubicle adjacent to her while she was in a cubicle.
She was under the impression that the phone was recording and that a male was in the cubicle adjacent to her, as she could hear what she perceived as a man masturbating.
The man was not visible to the girl’s companion, who had gone to get her a drink of water. Upon her return, they both exited the toilet area.
The man’s image was captured by the officers from CCTV footage and submitted for retrospective facial recognition using software.
Officers initiated enquiries regarding Nica’s whereabouts after the search yielded a match.
The following morning, Nica was apprehended at an address in Warrington on suspicion of voyeurism. Officers confiscated a mobile phone that Nica was carrying.
The defendant’s offences were committed “for the purpose of obtaining sexual gratification,” as indicated by the charges for which he was convicted.
On September 21, his previous suspended sentence order was imposed for the theft of £329.94 worth of men’s clothing from TK Maxx in Solihull and the intentional exposure of his genitals in Chester in order to attract the attention of an individual.
Nica, a resident of Cherry Road in Chester, was sentenced to 36 weeks in prison and ordered to adhere to the sex offender notification and registration requirements for a period of 10 years.
Additionally, he was issued two restraining orders that forbade him from communicating with two females for a period of five years. Additionally, he was required to pay a £187 surcharge to support victim services.
