Trevor Smith, aged 50, of Hall Street, St Helens, Merseyside, was sentenced to 10 months’ imprisonment at Liverpool Crown Court after pleading guilty to exposure, possession of cannabis, and breaching a suspended sentence order.
The court heard that the incident occurred at around 9.50 pm on 18 March 2021. A resident in a neighbouring flat looked out of her window after hearing noise from the street and observed a group of approximately nine male and female teenagers walking past.
Smith was seen on his apartment balcony leaning over the ledge with his boxer shorts pulled down to his knees, completely naked and performing a sex act on himself while watching the youths below.
The onlooker contacted the police, and officers were dispatched to Smith’s flat. Upon entering, officers found Smith sweating heavily, out of breath, dressed only in a towel, with pornography actively playing on his mobile phone. A small quantity of cannabis was also recovered from the premises.
The offence placed Smith in breach of a 26-week suspended prison sentence imposed two years earlier for a public disorder conviction in Lancashire.
Appearing before Liverpool Crown Court, Smith entered guilty pleas to:
- One count of exposure
- One count of possession of a Class B drug (cannabis)
- One count of breaching a suspended sentence order
The presiding judge activated the custodial term and sentenced Smith to a total of 10 months’ imprisonment, alongside a 10-year requirement to sign the sex offenders register.
