Bradley Fitzpatrick, aged 22, of Kinsman Estate, Bodmin, Cornwall, has been sentenced to an extended determinate sentence of 12 years at Truro Crown Court after being convicted of a series of rapes and sexual assaults against two female victims.
The court heard that Fitzpatrick committed the offences between December 2021 and 2022 against two separate young women who were unknown to one another. In December 2021, Fitzpatrick encountered the first victim, who was in her late teens, at a garage in Bodmin. During an ensuing walk, Fitzpatrick carried out a sexual assault and raped her. The victim disclosed the assault immediately upon returning home, leading to a police report.
Following his arrest, Fitzpatrick repeatedly lied during formal police interviews, falsely claiming that he had never encountered the victim that day. When later presented with conclusive forensic evidence gathered by Devon and Cornwall Police, Fitzpatrick altered his defence at trial to claim that the sexual contact was consensual.
During 2022, Fitzpatrick targeted a second victim, aged between 16 and 18 at the time. On two distinct occasions, during what began as consensual sexual activity, the victim explicitly revoked and withdrew her consent. Despite the victim making her lack of consent unmistakably clear, Fitzpatrick ignored her and carried out rapes on both occasions, alongside subjecting her to a sexual assault on a third occasion. In interviews regarding these allegations, Fitzpatrick maintained that all contact had been consensual.
Following an arrest in connection with a separate matter, digital forensic examiners inspected Fitzpatrick’s mobile phone and discovered a collection of indecent images of children alongside extreme pornography depicting bestiality.
Under UK legislation, all victims of sexual offences are protected by lifelong statutory anonymity.
At the conclusion of a Crown Court trial, Fitzpatrick was found guilty of three counts of rape, three counts of sexual assault, two counts of sexual assault by penetration, and one count of causing a person to engage in sexual activity without consent. He additionally pleaded guilty to making indecent images of children and possession of extreme pornography.
On Thursday 24 September, trial judge James Adkin assessed Fitzpatrick as dangerous, noting that he presented a clear threat to young women and had lied profusely and with ease throughout the investigation. The judge passed an extended sentence comprising an immediate custodial term of nine years’ imprisonment with an extended licence period of three years. Under extended determinate sentencing legislation, Fitzpatrick must serve at least two-thirds of the nine-year custodial element in prison before becoming eligible for parole consideration.
The court also made Fitzpatrick subject to a 20-year Sexual Harm Prevention Order and placed him on the Sex Offenders Register for life. Detective Constable Emily Rickard commended both victims for remaining engaged with the investigation, ensuring a dangerous sexual predator was removed from the community.
