In 2021, Neil Bailey, aged 54, of Uphills, Gainsborough, Lincolnshire, was handed a suspended prison sentence at Lincoln Magistrates’ Court after pleading guilty to engaging in sexual activity with a child under 13.
The prosecution arose after an 11-year-old schoolgirl reported inappropriate digital messages to a teacher.
The court heard that the victim was the same age as Bailey’s daughter and attended the same school.
Bailey transmitted sexually explicit messages to the child, asking if she was a virgin, stating he wanted to kiss her and see her body, and proposing sexual activity.
School staff made an immediate safeguarding referral to Lincolnshire Police, who launched an investigation.
Detectives examined Bailey’s communications and uncovered evidence that he had also made contact with another young girl for sexual purposes.
Bailey made full admissions during his police interview and pleaded guilty at Lincoln Magistrates’ Court to:
- Engaging in sexual activity with a child under 13
Magistrates sentenced Bailey to 20 weeks’ imprisonment, suspended for two years, and ordered him to complete up to 40 days of a rehabilitation activity requirement.
The court also made Bailey subject to a five-year Sexual Harm Prevention Order (SHPO), ordered him to register on the Sex Offenders Register for seven years, and imposed £300 in prosecution costs.
Following his sentencing, Bailey committed a breach of his Sexual Harm Prevention Order by posting on Facebook, where he disputed his guilt, identified the 11-year-old victim by name, and published a photograph of her online.
