Andrew Boyne, now residing in Inverkeithing, was sentenced to 30 months’ imprisonment at Falkirk Sheriff Court after being found guilty of sexually assaulting a vulnerable 16-year-old child and an 18-year-old woman in Stirling.
The court heard that the principal offence occurred in a flat in Stirling while Boyne’s partner was out attending bingo. Boyne initially touched the 16-year-old child inappropriately under her bedcovers. A few days later, while alone in the property with the victim, Boyne placed her in tight silver chain-type handcuffs on a bed, leaving her unable to move or defend herself before subjecting her to a further sexual assault.
During the trial, the jury viewed recorded police interviews where the victim detailed being scared and immobilised during the attack. The court heard that although the victim was 16 at the time of the offence, she had the cognitive functioning age of a much younger child.
The jury also convicted Boyne of a separate charge relating to May 2012, where he sexually assaulted an 18-year-old woman residing at a bed and breakfast establishment in the Raploch area of Stirling.
Following the trial, the presiding sheriff described the offence against the restrained child as significant and particularly distasteful.
The court imposed a total custodial sentence of 30 months’ imprisonment.
