In 2019, the Offender Database recorded that Nigel Birch, then 66, was jailed for two years and eight months for his involvement in international child sexual exploitation. On Monday, 10 June 2019, the defendant, formerly of Swindon, Wiltshire, but residing in Stroud, Gloucestershire, at the time of his sentencing, appeared at Swindon Crown Court. The court reported that Birch paid a mother in the Philippines to have her daughters, aged 10 and 15, sexually abused via an online video stream.

The investigation established that Birch used his bank account to make 172 payments to the Philippines and chatted with the girls’ mother about the sexual acts that would be performed by their male cousins. Wiltshire Police reported that while prosecutors could not prove the specific acts occurred, Skype logs on Birch’s computer showed he had set up the “vile” shows. The prosecution reported that a forensic search also uncovered a collection of indecent images of children as young as seven on his laptop and hard drives.

Judicial Findings and Investigative Detail

The court reported that Birch initially claimed the payments were for philanthropic reasons to help a woman out of the sex trade. Swindon Crown Court heard how he later accepted he had paid for approximately 12 shows where children would strip naked, deriving sexual pleasure from what he saw. The prosecution reported that since his arrest, Birch’s wife had left him, he lost his job, and one of his grown-up daughters no longer speaks to him in Stroud, Gloucestershire.

Judge Jason Taylor QC noted that Birch had clearly logged on for the shows and had made admissions regarding his attraction to youngsters. For his actions in Swindon and Stroud, the defendant pleaded guilty to facilitating the commission of a child sex offence and making indecent images of children. The judge noted that the custodial sentence was necessary to reflect the predatory nature of funding international child abuse and to protect children from further harm.

Sentence and Statutory Requirements

For his crimes in England and the Philippines, Nigel Birch was handed:

  • Custodial Sentence: Two years and eight months in prison.
  • Sex Offenders Register: Notification requirements were activated for life.
  • SHPO: Made subject to a Sexual Harm Prevention Order.
  • Judicial Oversight: Sentenced at Swindon Crown Court following guilty pleas.
  • Origin: Swindon, Wiltshire (last residing in Stroud, Gloucestershire).

Monitoring and Public Protection

Birch is managed under Multi-Agency Public Protection Arrangements (MAPPA) by Wiltshire Police, Gloucestershire Police, and the prison estate. Due to the international and digital nature of his sexual offending, his management is subject to high-level oversight by the Public Protection Unit.

As a member of the Sex Offenders Register, Birch must comply with notification requirements regarding his identity and residence for the remainder of his life. Authorities state that his history of paying for the online abuse of children necessitates permanent and stringent monitoring of his conduct and digital access. Any further sexual misconduct or breach of his SHPO in Swindon, Stroud, or elsewhere will result in immediate arrest and a return to the court system for a significantly lengthier term of incarceration.
