The investigation established that on 29 March 2018, O’Donnell targeted two 13-year-old girls on a number 26 McGill’s bus travelling between Braehead Shopping Centre and Paisley. The girls reported that the defendant made “reprehensible” and suggestive gestures, including licking his lips, blowing kisses, and touching his inner thigh and private parts while staring at them. As the girls prepared to depart the bus near Dundonald Road, O’Donnell communicated with them directly, stating, “bye, baby dolls.”
Judicial Findings and Investigative Detail
The court reported that O’Donnell had a “vile” and extensive history of sexual offending dating back to the 1980s. The jury heard that he had been an alcoholic since the age of 13 and began committing sexual offences in his 30s. His criminal record included a five-year sentence from the High Court in Glasgow in 1998 for abusing three girls aged 10 to 12, as well as multiple previous convictions for flashing at schoolgirls and repeatedly breaching his SOPO in Newcastle, Inverness, and Paisley.
Procurator Fiscal Depute David McDonald noted that while O’Donnell might have appeared to other passengers as merely a “drunk old man,” his gestures constituted a calculated and prohibited attempt to communicate with children. Sheriff Tom McCartney noted that the defendant posed a significant danger to young women and that a prison sentence was the only appropriate response to his persistent disregard for court orders. The prosecution emphasised that O’Donnell was a “serious” repeat offender who required constant monitoring to prevent further predatory behaviour.
