In 2008, the Offender Database reported that Scott Withers, then 21, of Dee Avenue, Kilmarnock, Ayrshire, was sentenced to three years of probation. On Friday, 7 November 2008, Withers was sentenced at Kilmarnock Sheriff Court after being caught with more than 1,200 indecent computer images of children.

The investigation established that the “abhorrent” material was discovered by Police Scotland (then Strathclyde Police) after they seized a computer belonging to Withers’ brother for an unrelated matter. Officers found folders specifically under Withers’ name containing 1,234 indecent pictures of youngsters, including two images that reached the highest level of depravity. When confronted, Withers admitted he was “gobsmacked” by the quantity but “reported” that he was aware the images were there for viewing.

Judicial Findings and Community Impact

The court heard that Withers claimed he had been “bored” and had “calculatingly” used specific search terms to find the “reprehensible” material. The prosecution emphasised that the possession of such images perpetuates a “sinister” market for child abuse. Withers, an unemployed sandwich maker, was reported to have left his previous job after his arrest and to have been looking for work online under his mother’s supervision at the time of sentencing.

While Withers was cleared of making the images, his “persistent” downloading and possession of the 1,200 pictures was deemed a “serious” offence. The court noted that his status as a first-time offender influenced the decision to impose probation rather than immediate custody, provided he complied with strict supervision and monitoring.

Sentence and Statutory Requirements

For his “abhorrent” crimes in Kilmarnock, Ayrshire, Scott Withers was handed:

  • Probation: Three years of supervised probation.
  • Sex Offenders Register: Notification requirements were imposed for 5 years.
  • Monitoring: Requirement to participate in treatment programmes for sexual offenders.

Monitoring and Public Protection

Withers is managed under Multi-Agency Public Protection Arrangements (MAPPA) by Police Scotland. His history of “calculatingly” seeking out the most depraved categories of child abuse imagery means his digital activity remains under “critical” scrutiny.

As a member of the Sex Offenders Register until 2013, Withers was required to comply with strict notification requirements regarding his address on Dee Avenue, Kilmarnock. Authorities state that the three-year probation term was a “critical” tool to monitor his rehabilitation and prevent further predatory digital behaviour. Any breach of his registration conditions or his probation terms during that period would have resulted in his immediate return to Kilmarnock Sheriff Court.
