In 2020, the Offender Database reported that John Mulherron, then 45, was sentenced to seven years at Kilmarnock Sheriff Court. On Friday, 7 February 2020, Mulherron was jailed for a series of degrading and violent attacks against his partner in Saltcoats, Ayrshire. The presiding judge, Sheriff Elizabeth McFarlane, described the offences as “disgusting” acts of violence that left the victim with physical and emotional scars.
The investigation established that between October and December 2018, Mulherron subjected the 34-year-old woman to a campaign of domestic and sexual abuse. The court heard he forced the victim to strip naked before scrawling obscenities such as “slut” on her forehead and “cheater” on her chest in lipstick. He was also convicted of a sexual assault involving a baseball bat and physical attacks that occurred while the victim was driving.
Victim Impact and Judicial Findings
The court reported that the abuse caused a significant change in the victim’s personality and appearance; she shifted from being outgoing to withdrawn, eventually using makeup only to conceal the injuries Mulherron had inflicted. During the trial, the jury viewed images of scratches and bruises of various ages, and the victim was required to relive her ordeal on the witness stand. The offences were formally aggravated under the Abusive Behaviour and Sexual Harm (Scotland) Act 2016.
Sheriff McFarlane blasted Mulherron for his lack of remorse and for claiming the allegations were a fabrication. Although the judge initially considered referring the case to the High Court due to the severity of the crimes, she ultimately dealt with the sentencing herself, noting his lack of previous convictions for domestic or sexual violence.
Sentence and Statutory Requirements
For his reprehensible crimes in Saltcoats, Ayrshire, John Mulherron was handed:
- Custodial Sentence: A five-year prison term, backdated to December 2019.
- Extended Sentence: A two-year extension period involving strict community monitoring upon release.
- Sex Offenders Register: Notification requirements for an indefinite period (life).
- Non-Harassment Order: A five-year ban on approaching or contacting the victim in any manner.
Monitoring and Public Protection
Mulherron is managed under Multi-Agency Public Protection Arrangements (MAPPA) by Police Scotland. His history of “systematic” domestic abuse and sexual assault means he remains under critical scrutiny by authorities in both Ayrshire and his native Glasgow.
As a lifetime member of the Sex Offenders Register, Mulherron must comply with strict notification requirements regarding his movements and address. Authorities state that the combination of his custodial term and the two-year extended sentence is designed to ensure maximum public protection. Any breach of his non-harassment order or registration conditions will result in his immediate return to Kilmarnock Sheriff Court.
