Kyle Tyson, aged 20, formerly of Hillside Crescent, Chorley, Lancashire, has been handed an extended determinate sentence of nine years at Preston Crown Court after being convicted of sexually assaulting and attempting to rape a 12-year-old girl.
The offence took place in Preston in May 2022.
The court heard that Tyson targeted the young girl—whom he knew—while attending a funeral wake, subjecting her to a sexual assault and attempting to rape her.
In a harrowing Victim Personal Statement presented to the court, the young survivor outlined the severe toll the crime had taken on her formative years.
She explained that she had been left carrying trauma far beyond her years, resulting in severe anxiety that eventually made attending school impossible.
She described the acute distress of having to recount the incident to police and give evidence in court after Tyson refused to admit his crimes.
Tyson denied the charges, forcing the victim to testify during a Crown Court trial in June.
Following deliberations, the jury convicted him on two counts:
- Attempting to rape a child under 13
- Sexual assault
Appearing for sentencing on Friday, 18 September, the court found Tyson to be a dangerous offender posing a significant risk of harm.
The judge imposed an extended sentence of nine years, comprising an immediate custodial term of six years (72 months) followed by an extended licence period of three years.
Tyson was also made subject to a 15-year Sexual Harm Prevention Order (SHPO) and ordered to register as a sex offender indefinitely (for life).
Release Calculation: Because Tyson was sentenced as a dangerous offender under extended determinate sentence provisions, statutory automatic early release does not apply. Tyson is required to serve a minimum of two-thirds of his six-year custodial sentence (four years / 48 months) in prison custody before becoming eligible to apply for parole. His release remains entirely at the discretion of the Parole Board, which must be satisfied that he is safe to be managed in the community. If released, he will serve the remainder of the custodial sentence plus the three-year extension on licence under strict probation supervision.
