A rapist who subjected a severely intoxicated 15-year-old girl to a violent sexual attack in Middleton was released into the community after serving approximately 13 months of a 27-month sentence.

Kyle Jorden Marshall, who has since relocated to the Blackpool area, was sentenced at Manchester Minshull Street Crown Court following an inquiry conducted by Greater Manchester Police.

The incident occurred on 29 June 2019 in Middleton, Greater Manchester. At the time of the offence, Marshall was 16 years old.

The court heard that the 15-year-old victim had consumed alcohol to the extent that she was severely incapacitated and physically incapable of movement or resistance. Marshall, who was sober, exploited her vulnerable condition, pinning the child down and carrying out a violent sexual assault. The physical force used during the attack caused visible bruising and injuries across the victim’s wrists, arms, and thighs.

Following a complaint made to the police, Greater Manchester Police officers arrested Marshall. During formal interviews under caution, Marshall refused to account for his actions, responding with “no comment” to all questions posed by detectives.

Marshall initially maintained a plea of not guilty during court appearances in November 2022 before receiving a sentence for rape in February 2023.

The Crown Court judge imposed a custodial sentence of 27 months’ imprisonment. Under standard statutory release provisions for determinate sentences of that length, Marshall served approximately 13 months in custody before being released on licence under the supervision of the Probation Service.

The court further ordered Marshall to comply with notification requirements on the Sex Offenders Register for a period of ten years under the Sexual Offences Act 2003 and placed him on the barred lists preventing regulated activity with children.

Following his release, the survivor shared a public statement highlighting the impact of the attack and the importance of awareness: “At just 15, I endured the worst experience of my life. I cannot change what he did to me, but I can now speak out and try to help others. If sharing my story protects even one other girl from going through what I went through, then speaking out will have made a difference.”

Under the provisions of Section 49 of the Children and Young Persons Act 1933 and the Sexual Offences (Amendment) Act 1992, all child victims and complainants connected to criminal proceedings are protected by automatic, lifelong statutory anonymity. Publishing, broadcasting, or disseminating any details, names, addresses, educational facilities, or photographs capable of leading to public identification is strictly prohibited under UK law.

Marshall stood convicted of:

Rape

Sentencing outcome and statutory measures:

27 months’ immediate custody (approximately 13 months served prior to licence release)

Ten-year requirement to register on the Sex Offenders Register under the Sexual Offences Act 2003

Permanent barring from working with children or vulnerable adults (Children’s and Adults’ Barred Lists)

Strict post-custodial statutory licence supervision conditions enforceable upon release
