Adam Mushtaq, then aged 28, of Croftfoot, Glasgow, has been convicted at Glasgow Sheriff Court of sexually assaulting a vulnerable patient while working as a healthcare support worker.
The conviction follows an investigation by Police Scotland into an incident that occurred on 25 January 2024 at a hospital in Glasgow.
Mushtaq had been assigned to carry out dedicated one-to-one monitoring of a 20-year-old female patient who was in a highly vulnerable state after being admitted following an attempt on her own life.
During the trial, jurors listened to recorded evidence provided by the survivor describing how Mushtaq exploited his position of care.
Mushtaq initially used his mobile telephone to show her content before presenting two naked photographs of himself, telling the victim not to look.
He then hugged her, kissed her hand, described her as beautiful, and made inappropriate sexual comments, asking if his remarks caused her discomfort.
The court heard that Mushtaq subsequently closed the room door and put his hand down the victim’s pyjama bottoms, carrying out a sexual assault.
He ignored the patient’s requests to stop, with the assault halted only when medical doctors unexpectedly entered the room.
To cover his conduct, Mushtaq claimed to the doctors that he had merely been playing the mobile video game Grand Theft Auto alongside the patient.
During the court proceedings, the victim dismissed this claim as an outright fabrication.
The court was told that Mushtaq remained with the woman until she was discharged, accompanying her into a staff lift where he kissed her again and attempted to pull up her jumper.
The victim alerted support workers to the offences shortly after returning home.
Mushtaq, a first offender, denied the allegations during the trial, but the jury dismissed his defence and returned a guilty verdict for sexual assault.
The presiding sheriff condemned Mushtaq’s conduct, highlighting the profound breach of trust inherent in sexually abusing a vulnerable patient placed under official medical observation.
The sheriff warned the defendant that an immediate custodial disposal is the probable outcome.
Mushtaq was placed on the Sex Offenders Register, with sentencing formally deferred to allow criminal justice social work reports and risk assessments to be compiled.
