In 2021, Brian Penn, a then 30-year-old man from Ayr, was jailed following a Police Scotland investigation into the death of his seven-week-old son.
Brian Penn, of Ayr, was sentenced at the High Court in Glasgow to 12 years in prison after being found guilty of culpable homicide and a separate charge of assault to severe injury and danger of life. The court heard that Penn carried out a violent physical attack on his infant son, Kaleb Penn, at their home in Ayr on 1 November 2017. Penn violently shook the baby and inflicted blunt force trauma, resulting in a skull fracture, severe brain injury, bleeding to the brain, and fractured ribs.
The child died two days later in the hospital from his injuries. During legal proceedings, prosecutors demonstrated how Penn initially attempted to mislead medical staff and police officers by claiming the infant had suffered a choking episode during feeding. Furthermore, Penn attempted to shift blame onto the boy’s mother during the investigation. Medical experts testified that the severe internal injuries were consistent with major trauma, while Judge Lord Weir condemned Penn for betraying his parental duty of care to a helpless infant.
In addition to his 12-year custodial sentence, Penn was made subject to post-release monitoring requirements to manage public safety risks.
The court emphasised the gravity of the physical violence inflicted on a vulnerable victim when handing down the extended prison term.
