In 2019, the Offender Database reported that Justine Duffy, then 24, of Oakland Heights, Drumkeen, Donegal, was convicted of animal cruelty at Letterkenny District Court. Duffy pleaded guilty to an offence under the Animal Health and Welfare Act 2013 after failing to provide sufficient food for her Rottweiler dog.
The investigation began following a call to the ISPCA National Animal Cruelty Helpline. Senior Inspector Kevin McGinley conducted multiple visits to the property before contacting Duffy on 11 May 2017. He observed a female Rottweiler named “Titch” in an “emaciated” state, with her ribs, hips, and backbone clearly protruding.
Veterinary Findings and Recovery
Upon surrender, the dog was immediately transported to a vet in Letterkenny. The examination reported:
- Weight: Only 20.8kg at the time of rescue.
- Health Screening: Blood tests were conducted to rule out underlying conditions such as diabetes; the results confirmed that the weight loss was due to a lack of food.
- Progress: While in ISPCA care for 20 weeks, Titch gained 12kg—more than half of her initial body weight.
Inspector McGinley emphasised that pet owners have a legal obligation to provide sufficient nutrition and must proactively seek veterinary advice if an animal stops eating. He described it as “shocking” that a dog had reached such a state.
Sentence and Financial Penalties
Judge Paul Kelly considered the evidence of the “shocking” neglect and handed down the following:
- Fine: Duffy was fined €100.
- Veterinary Costs: Ordered to pay €725.08 to the ISPCA to cover the costs of Titch’s medical treatment and recovery.
- Legal Consideration: One offence under Section 13 was admitted, with further charges under Sections 11 and 12 taken into consideration.
Outcome for the Animal
Following her recovery at the ISPCA National Animal Centre in Longford, Titch was successfully rehomed with a new family in Co. Kildare.
An Garda Síochána and the ISPCA state that they will continue to prosecute owners who fail to meet the basic welfare needs of their animals. Any further reports of neglect involving Duffy would result in her immediate return to the District Court.
