During the trial, Smith “evasively” denied all charges, labelling his victims as “scheming liars.” However, the jury rejected his claims following graphic testimony from the survivors. One victim, now in her 40s, reported that Smith had “stolen her childhood” and described him as being “touchy-feely” throughout her youth. She also detailed being beaten with a belt, a poker, a shovel, and a wooden spoon.
Judge Lord Matthews emphasised that “mere words are inadequate” to describe the “abhorrent” nature of Smith’s actions. He noted the “chilling” detail provided in the victim impact statements, which outlined how the survivors had to “block out” the trauma simply to survive.
Sentence and Statutory Requirements
For his “depraved” crimes in East Ayrshire, David Smith was handed:
- Custodial Sentence: 10 years in immediate custody.
- Sex Offenders Register: Notification requirements were imposed for life.
- Professional Barring: Permanent disqualification from working with children or protected adults.
