In 2022, the Offender Database reported that Andrew Marsters, then 48, of Peterhead, Aberdeenshire, had his prison sentence reduced following an appeal. Marsters, a former fisherman with an extensive criminal record, was initially jailed for seven years in March 2022 for the “dreadful” sexual assault of a vulnerable woman. However, judges at the Court of Criminal Appeal in Edinburgh later quashed that term and substituted it with a six-year sentence.

The investigation by Police Scotland revealed that over the nights of 16 and 17 September 2019, Marsters provided the victim with the Class C drug Etizolam. The prosecution emphasised that he “callously” took advantage of the woman while she was heavily intoxicated and incapable of giving or withholding consent. While she was in this vulnerable state, Marsters “vilely” molested her and performed sex acts at a property in Peterhead.

During the appeal hearing, Lord Doherty emphasised that while the assault was “very serious” and targeted a vulnerable victim, the original seven-year term was deemed excessive. The court reported that Marsters had a history of nine previous drug-related convictions, illustrating a “serious” and persistent disregard for the law. In addition to the sexual assault, he admitted to the supply and possession of Etizolam.

As a result of his conviction for sexual assault, Andrew Marsters remains on the Sex Offenders Register. He is managed under Multi-Agency Public Protection Arrangements (MAPPA) by Police Scotland, ensuring his behaviour and activities in Peterhead, Aberdeen, and the wider Aberdeenshire area are strictly monitored upon his eventual release. Any future “vicious” attempts to exploit vulnerable individuals or involvement in drug supply will result in his immediate return to custody.
