Physical Assault and Judicial Findings
Less than a week after the grooming incident, Holgate sexually assaulted a 15-year-old girl. The court heard how he “viciously” moved his hand up her leg toward her vagina; when the victim reminded him of her age, he “sinisterly” replied that “age is just a number.” Four days later, CCTV at a railway station captured Holgate “reprehensibly” grabbing the same girl by her coat, pulling her toward a toilet, and attempting to kiss her while stating, “the things I would do to you.”
In her victim impact statement, the 15-year-old reported that she struggled to sleep and feared he would target others. The 13-year-old survivor emphasised that she now sees the world in a “different light” and has become “weary” of others. Judge Peters described Holgate’s actions as “manipulative” and “horrific” noting that despite his mental health issues and claims of trying to avoid gangs, his “persistent” predatory behaviour made custody “inevitable.”
Sentence and Statutory Requirements
For his “serious” crimes in Colchester, Tristan Holgate was handed:
- Custodial Sentence: One year and 10 months in immediate custody.
- Sex Offenders Register: Notification requirements were imposed for 10 years.
- SHPO: A 10-year Sexual Harm Prevention Order was issued to strictly monitor his conduct.
