A Sudanese asylum seeker and British resident, Osama Alkhair, has been incarcerated following an attempt to sexually assault an unconscious woman.
Osama Alkhair, a Sudanese asylum seeker with established status in the UK, has received a sentence of seven years and four months for attempting to rape an unconscious woman in Croydon.
The event transpired on December 29 of the previous year, when Alkhair assaulted the woman, who was incapacitated due to alcohol and narcotics.
She was unclothed from the waist down, and he was disrobing when a bystander intervened.
Osama Alkhair, asserting a birthdate of January 1, 1988 (rendering him 37 years old), arrived in the UK about 2015 to escape persecution, leaving his wife and two children behind.
Osama Alkhair had received permanent leave to remain, resided in a hostel in Croydon, and was employed as a worker before to his arrest.
He refuted the accusation but was found guilty by a jury on September 12. On September 15 at Croydon Crown Court, Judge Tony Hyams-Parish sentenced Osama Alkhair, stipulating that he must spend two-thirds of his term in jail prior to compulsory deportation.
Prosecutor Ravi Dogra stated: “The defendant asserts that his date of birth is January 1, 1988, which would render him 37 years old.”
Osama Alkhair arrived in the UK as an asylum seeker from Sudan, presumably in 2015. The Crown is unable to verify the accuracy of the date of birth.
Defence attorney David Smith stated that Osama Alkhair has been in detention since his apprehension.
Judge Hyams-Parish stated to Osama Alkhair: “You exploited a woman who was evidently unable to consent to sexual intercourse or any form of sexual activity due to her severe intoxication and unconsciousness, seemingly resulting from a combination of alcohol and drugs.”
I cannot fathom the experience of being aware that someone has transgressed against you, as you did to the complainant in this case, yet having no recollection of the event.
He stated, “Had you not been interrupted, or even if you had been interrupted moments later, you would have proceeded to assault her.”
Osama Alkhair will face automatic deportation unless he succeeds in an appeal, which he no doubt will.
