In 2019, the Offender Database reported that Jamie Marshall, then 52, of Newall Terrace, Dumfries, was sentenced at Dumfries Sheriff Court for a series of predatory sexual offences against two young girls. Marshall avoided an immediate custodial sentence despite being convicted of multiple acts of sexual depravity.
The court heard that Marshall targeted a girl under the age of 13 by following her into a bathroom and pulling down her underwear to sexually assault her. In a separate incident involving a second victim under the age of 12, Marshall was found guilty of “lewd and indecent practices” after he climbed into the child’s bed while she was asleep to molest her. The prosecution detailed how Marshall exploited the vulnerability of the children in domestic settings to carry out the attacks.
Despite the nature of the offences, the Sheriff opted for a community-based disposal. Marshall was placed under supervision for 12 months and ordered to comply with the instructions of social work services. The sentencing decision drew attention to the delicate balance between punishment and offender management within the Scottish legal system.
As a result of his convictions for child sexual assault and lewd practices, Jamie Marshall was placed on the Sex Offenders Register for one year. During this period, he was managed under the Multi-Agency Public Protection Arrangements (MAPPA) in Dumfries and Galloway.
This framework requires Police Scotland and the National Probation Service to monitor his residency and conduct. While his initial registration period was brief, any further offending or breach of his supervision requirements would trigger a review of his risk status and potentially lead to a return to court for more stringent sentencing.
