In 2026, the Offender Database reported that James Hateley, 30, was remanded in custody at Edinburgh Sheriff Court after pleading guilty to sexually abusing a 13-year-old girl in a city centre McDonald’s. Hateley, from Tranent, East Lothian, met the vulnerable schoolgirl after she left her supported accommodation without permission.
The court heard that the pair were seen holding hands and kissing in the takeaway outlet before entering a disabled toilet together at approximately 6:30 am on 29 May 2022. Hateley locked the door before removing the child’s clothing and trainers, molesting her, and engaging in sexual intercourse. The victim returned to her residential unit the following day and disclosed the assault during a police interview.
Remand and Failure to Appear
Hateley was arrested and eventually pleaded guilty to a charge of engaging in sexual activity with a child. He also admitted to a further offence of failing to appear at a scheduled court hearing on 12 March 2025.
Sheriff Julius Komorowski was informed that a required social work report was not yet available for the sentencing hearing. As a result, Hateley was returned to custody to await his next court appearance. His name has already been added to the Sex Offenders Register on an interim basis while the court determines the final length of his sentence.
Banning and Registration
In addition to the criminal proceedings, the court reported that Hateley’s details will be forwarded to Scottish Ministers. This process is intended to ensure he is added to the list of individuals legally barred from working with children or vulnerable adults in the future.
For his actions in Edinburgh, James Hateley faces:
- A significant custodial sentence (to be determined next month).
- Inclusion on the Sex Offenders Register.
- A permanent ban from regulated work with children and vulnerable groups.
Monitoring and Public Protection
Hateley is managed under Multi-Agency Public Protection Arrangements (MAPPA) by Police Scotland. His residency in Tranent, East Lothian, and his history of targeting vulnerable children in Edinburgh will be under intense scrutiny upon his eventual release.
Police Scotland emphasises that the management of registered sex offenders involves strict notification requirements and proactive monitoring of their behaviour in public spaces. Any attempt by Hateley to contact the victim or frequent locations popular with children will result in his immediate arrest and return to custody.
