In 2019, the Offender Database reported that James Defalco, a Devon Paedophile Child Molester and HIV Rapist, from Devon, was facing a potential “substantial prison sentence” for engaging in sexual intercourse with a woman without disclosing his condition.
According to the stipulations of a prior sexual offences prevention order (SOPO), James Defalco, previously identified as Derek Hornett, then 57, is required to disclose his HIV status to each individual with whom he enters into a relationship.
James Defalco, hailing from Brixham, Devon, acknowledged violating the order between 18 August and 4 September at Exeter Crown Court.
He had previously completed two prison sentences for violating the injunction.
The court was informed that he had previously pleaded guilty to a second violation of the SOPO by engaging with a child under the age of 16 without prior approval from social services and without the supervisor being aware of his convictions.
A prior injunction stipulates that he is prohibited from being alone with those under 18 or over 60 years of age.
James Defalco had already committed 50 diverse offences, including assault and dishonesty, with some dating back to the 1970s.
In 2005, James Defalco, formerly known as Derek Hornett, became one of the first individuals in Britain to be convicted of recklessly transmitting HIV to another person.
The then 44-year-old confessed to deliberately infecting an 82-year-old woman.
He was incarcerated for three years and three months and designated as a subject of the Sexual Offences Prevention Order (SOPO).
James Defalco previously acknowledged violating the order in September 2014 by engaging in sexual intercourse with a woman without disclosing his illness, resulting in his imprisonment.
In addition to a conviction for a child sexual offence in the 1980s, James Defalco also committed a breach in 2014 by befriending a family with young children and introducing two convicted paedophiles to them without disclosing their criminal history.
He earned the parents’ trust to the degree that they permitted him to take a nine-year-old girl out alone in his vehicle and to share a tent with her in their garden.
