The jury’s verdict ensued from an extensive trial in which the victim outlined the abuse, illustrating how Bernard McNamee, a Eucharistic Minister at St. Theresa’s Catholic Church in Sion Mills, cultivated a friendship with the family to obtain access to the child.
The victim, then a child, recounted that McNamee often visited his family, bringing confections and pastries, while directing particular attention towards him.
The child felt esteemed as Bernard McNamee frequently purchased comics and placed chocolates near his bed.
Bernard McNamee invited the youngster to spend the night at his residence, a proposal that his mother originally declined.
Ultimately, following sustained manipulation via presents and attention, the mother acquiesced to the boy’s stay, convinced of his safety.
On the specified night, Bernard McNamee transported the youngster to his residence, which contained both a single bed and a double bed in the same room.
The victim was directed to sleep in the double bed, and thereafter joined by Bernard McNamee.
The youngster remembered awakening at approximately 2 a.m. with a sense of discomfort, only to find McNamee molesting his genitals.
Agitated, he hurried to the toilet, where his mother attended to him.
The youngster asserted he had a headache and wished to return home, but his mother informed him it was too late and directed him back to bed.
The same day, Bernard McNamee transported the youngster home, and the youngster never reappeared at his residence.
Notwithstanding this, Bernard McNamee continued to visit the boy’s household, consistently leaving chocolates by the child’s bed.
On one occasion, the victim observed McNamee consuming alcohol, which was atypical as McNamee had consistently claimed he abstained from drinking.
That evening, Bernard McNamee lodged overnight, occupying a spare bed in the child’s room.
In the early hours, the boy awoke to discover McNamee groping him once more.
The youngster, agitated, sought solace in his parents’ room but refrained from revealing the incident.
A comparable occurrence transpired subsequently, wherein Bernard McNamee entered the boy’s room at night and once more engaged in sexual contact with him.
The child stayed with his parents throughout the night, complaining of a headache.
Ultimately, the victim disclosed to a family member regarding the assault, indicating that Bernard McNamee had “touched him inappropriately.” The incident was reported to law enforcement, resulting in McNamee’s apprehension.
He refuted all accusations during police interrogations and upheld his innocence throughout the trial.
After careful consideration, the jury rendered a majority guilty decision on all charges.
Bernard McNamee was given bail pending sentencing, with Judge Peter Irvine QC warning that this decision should not be construed as an indication of the gravity of his offences.
